Terms and Conditions
These Terms and Conditions (“Terms”) govern your use of ScoutingCard.com (the “Service”) operated by Think Strong LLC (“we,” “us,” or “our”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.
1. Eligibility & Account Registration
1.1 Eligibility. You must be at least 13 years old to use the Service. If you’re under 18, you may use the Service only with involvement of a parent or guardian.
1.2 Account. To access certain features, you must create an account by providing accurate, complete information and a valid email address. You are responsible for safeguarding your password and for all activity under your account.
2. Services & Subscriptions
2.1 Description. Scouting Card is a digital recruiting hub that hosts athlete profiles, including stats, highlights, and personal story, and offers concierge‐built setup and edits.
2.2 Plans & Pricing. We offer tiered subscription plans (“Founders,” “Elite,” etc.) as detailed on our Pricing page. By subscribing, you agree to pay the fees and taxes in effect for your chosen plan.
2.3 Billing & Renewal. Subscriptions renew automatically at the end of each billing period unless canceled at least 3 days before renewal. You authorize us to charge your stored payment method for all fees.
2.4 Setup Fees & Edits. One-time setup fees and edit allowances vary by plan. Unused concierge edits do not roll over.
2.5 Refunds. Due to the bespoke nature of our concierge service, we do not offer refunds once a Scouting Card has been built. You may cancel future renewals at any time.
3. Content & Intellectual Property
3.1 Your Content. You retain ownership of any information or media you submit (“Your Content”). By submitting it, you grant us a worldwide, royalty-free license to host, display, reproduce, and share Your Content solely to provide the Service.
3.2 Our Materials. All trademarks, logos, text, graphics, and software provided by us are owned by Think Strong LLC or our licensors and are protected by copyright and other laws. You may not use our marks without our prior written permission.
4. User Conduct
4.1 Prohibited Activities. You agree not to:
- Violate any laws or third-party rights
- Upload malware, spam, or unsolicited communications
- Reverse-engineer or interfere with the Service’s operation
- Misrepresent your identity or access another user’s account
4.2 Enforcement. We may investigate and take any legal action against anyone who, in our sole discretion, violates this provision.
5. Privacy
Your use of the Service is also governed by our Privacy Policy, which is incorporated by reference.
6. Disclaimers & Limitation of Liability
6.1 Disclaimer of Warranties. The Service is provided “as-is” and “as-available.” We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
6.2 Limitation of Liability. To the maximum extent permitted by law, Think Strong LLC and its officers, directors, employees, or agents will not be liable for any indirect, incidental, special, or consequential damages arising out of your use of or inability to use the Service, even if advised of the possibility of such damages. Our total aggregate liability will not exceed the fees paid by you in the 12 months preceding the claim.
7. Indemnification
You agree to indemnify and hold Think Strong LLC and its affiliates harmless from any claims, losses, liabilities, and expenses (including attorneys’ fees) arising from your violation of these Terms or your use of the Service.
8. Termination
8.1 Termination by You. You may cancel your subscription at any time via your account settings; termination takes effect at the end of your current billing period.
8.2 Termination by Us. We may suspend or terminate your access for any breach of these Terms or for any conduct we deem harmful to the Service or other users.
8.3 Effect of Termination. Upon termination, your license to use the Service ends and we may delete your account and data in accordance with our Data Retention policy.
9. Modifications to Terms
We may update these Terms from time to time. We’ll post the new “Last updated” date at the top and notify you of material changes. Continued use of the Service after the changes constitute your acceptance of the updated Terms.
10. Governing Law & Dispute Resolution
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law provisions. Any dispute arising under these Terms shall be resolved exclusively in the state or federal courts located in Collin County, Texas.
